This website and online store are operated by Guva Health LLC, doing business as Guva Health (“Guva Health,” “Guva,” “we,” “us,” or “our”). Guva Health provides this website, its content, products, features, tools, and related services (collectively, the “Services”).
Guva Health is powered by Shopify, which provides the ecommerce platform that enables us to offer the Services.
These Terms of Service (“Terms”), together with the policies referenced below, describe your rights and responsibilities when using the Services. By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
1. Eligibility and Accounts
You must be at least 18 years old and legally capable of entering into a binding agreement to purchase products through the Services.
You agree to provide accurate, current, and complete account, billing, payment, and shipping information. You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account.
You may not transfer, sell, assign, or license your account to another person.
2. Dietary Supplement and Health Information
Guva Flex is a dietary supplement and is not a drug. Information provided through the Services is for general educational and informational purposes only. It is not medical advice and is not a substitute for advice, diagnosis, or treatment from a qualified healthcare professional.
Use products only as directed on their labels. Consult an appropriate healthcare professional before using a dietary supplement if you are pregnant or nursing, take medication, have a medical condition, are preparing for a medical procedure, or have questions about whether a product is appropriate for you.
Discontinue use and seek appropriate medical attention if you experience an adverse reaction. For a medical emergency, contact emergency services immediately.
Individual experiences vary. Nothing in the Services guarantees a particular health, performance, or wellness outcome.
3. Products
We make reasonable efforts to describe and display our products accurately. Product colors and appearance may vary based on your screen and device settings.
Product descriptions, availability, packaging, and pricing may be updated from time to time. Changes do not retroactively alter an order that we have already accepted, except where required to correct an error or comply with law.
We may discontinue products or limit quantities by customer, household, geographic region, or order. Nothing in this section limits rights provided by our published Return and Refund Policy, including the eligibility requirements and limitations of Guva’s 90-day first-order money-back guarantee.
4. Orders
Submitting an order is an offer to purchase. An order is accepted when we send an order confirmation indicating acceptance and successfully process the applicable payment.
We may reject, limit, or cancel an order for legitimate reasons, including suspected fraud, incorrect pricing, inventory limitations, shipping restrictions, resale activity, or violations of these Terms. If we cancel an order after payment has been collected, we will refund the applicable amount.
Review your order carefully before submitting it. We may be unable to change or cancel an order after fulfillment begins.
Purchases are intended for personal or household use and not for unauthorized resale or export.
5. Prices, Taxes, and Billing
Prices and promotions may change without notice. The price charged is the price displayed when the order is submitted, subject to correction of obvious errors.
Unless stated otherwise, displayed prices exclude applicable taxes and shipping charges. Any applicable charges will be shown before checkout is completed.
You represent that you are authorized to use the payment method submitted with your order. You agree to keep your billing and account information accurate and current.
6. Shipping and Delivery
Delivery dates are estimates and are not guaranteed. Delays may occur because of carriers, weather, incorrect address information, customs, or events outside our reasonable control.
Title and risk of loss pass to you upon documented delivery to the shipping address provided with the order, except where applicable law provides otherwise.
Contact hello@guvahealth.com promptly if an order is lost, damaged, defective, or delivered incorrectly. Additional terms appear in our Return and Refund Policy.
7. Returns and Refunds
Returns and refunds are governed by our Return and Refund Policy. That policy includes the eligibility requirements, multi-bottle limits, and procedures for our 90-day first-order money-back guarantee.
Products purchased through Amazon or another third-party retailer are subject to that retailer’s return process unless otherwise required by law.
8. Intellectual Property
The Services—including text, graphics, photographs, videos, audio, designs, logos, trademarks, and their arrangement—are owned by Guva Health or its licensors and are protected by applicable intellectual-property laws.
You may use the Services only for personal, noncommercial purposes. Without our prior written permission, you may not reproduce, distribute, modify, republish, publicly display, publicly perform, sell, license, or exploit material from the Services, except as permitted by applicable law.
Guva Health names, logos, product names, designs, and slogans are trademarks or trade dress of Guva Health or its licensors. Shopify names and marks belong to Shopify. Other names and marks belong to their respective owners.
9. Optional Tools and Third-Party Services
We may provide access to tools or services operated by third parties. We do not control those services and provide access to them on an “as available” basis.
Your use of third-party services may be governed by the third party’s own terms and privacy notice. Review those terms before using the service.
10. Third-Party Links
The Services may link to websites or platforms operated by third parties. We are not responsible for the content, availability, security, accuracy, or practices of those services.
Accessing a third-party service is at your discretion. Questions about third-party products or services should be directed to the applicable third party.
11. Relationship with Shopify
Guva Health is powered by Shopify, which enables us to provide the Services. However, any sales and purchases you make through our store are made directly with Guva Health.
By using the Services, you acknowledge that Shopify is not responsible for any aspect of sales between you and Guva Health, including injury, damage, or loss resulting from purchased products or services. To the extent permitted by law, you release Shopify and its affiliates from claims arising directly from purchases and transactions with Guva Health.
12. Privacy
Personal information collected through the Services is handled according to our Privacy Policy.
Because Shopify hosts the Services, Shopify also collects and processes certain information relating to your access and use. Review the Shopify Consumer Privacy Policy for more information.
13. Reviews and Feedback
If you submit a review, suggestion, idea, photograph, testimonial, or other content (“Feedback”), you grant Guva Health a nonexclusive, worldwide, royalty-free, transferable, and sublicensable license to use, reproduce, adapt, publish, display, and distribute that Feedback for operating, improving, and promoting the Services.
You represent that you own or have permission to submit the Feedback and that it does not violate another person’s rights or applicable law. You must disclose any compensation, free product, discount, or other material connection associated with your Feedback.
We may moderate or remove Feedback that violates these Terms, but we are not obligated to monitor all submissions. We will not condition incentives on a review expressing positive or negative sentiment.
14. Errors and Corrections
The Services may occasionally contain typographical errors, inaccuracies, or omissions involving product descriptions, prices, promotions, availability, shipping charges, or delivery estimates.
We may correct errors and update information. If a material error affects an order after payment, we may contact you for instructions or cancel and refund the affected order.
15. Prohibited Uses
You may not use the Services:
- For an unlawful, fraudulent, or malicious purpose.
- To infringe intellectual-property, privacy, or other legal rights.
- To submit false, misleading, abusive, defamatory, or harmful material.
- To distribute spam, malware, or unauthorized promotional material.
- To impersonate another person or entity.
- To interfere with the security or operation of the Services.
- To collect personal information about others without authorization.
- To bypass access restrictions or other protective measures.
Automated access must comply with our published technical controls, including robots.txt, and must not interfere with the Services. Search-engine crawlers, Shopify-authorized services, and other automated tools expressly authorized by us are permitted to operate within that authorization.
We may suspend or terminate access when we reasonably believe these Terms have been violated.
16. Termination
We may suspend or terminate access to the Services for violations of these Terms, unlawful activity, fraud, security threats, or other legitimate business reasons.
Termination does not affect obligations incurred before termination. Provisions that by their nature should survive—including intellectual property, Feedback, disclaimers, limitations of liability, indemnification, and governing law—will remain effective.
17. Disclaimer of Warranties
Except for express promises stated in these Terms, our Return and Refund Policy, or applicable product documentation, the Services are provided on an “as available” basis to the fullest extent permitted by law.
We do not guarantee that the Services will always be uninterrupted, timely, secure, or error-free.
Nothing in these Terms disclaims an express warranty, the Guva 90-day first-order money-back guarantee, or a consumer right that cannot legally be waived.
18. Limitation of Liability
To the fullest extent permitted by law, Guva Health and its affiliates, officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, punitive, or consequential damages arising from use of the Services.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including liability arising from fraud, willful misconduct, gross negligence, or applicable product-liability and consumer-protection laws.
Some jurisdictions do not permit certain liability exclusions, so portions of this section may not apply to you.
19. Indemnification
You agree to indemnify and hold Guva Health and its affiliates, officers, employees, contractors, and service providers harmless from third-party claims arising from your unlawful use of the Services, your material breach of these Terms, or your violation of another person’s rights.
This obligation does not apply to claims caused by Guva Health’s own negligence, misconduct, or violation of law.
20. Severability
If a provision of these Terms is found unlawful or unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain in effect.
21. Waiver and Entire Agreement
Failure to enforce a provision is not a waiver of that provision.
These Terms and the policies incorporated by reference constitute the agreement between you and Guva Health regarding the Services and supersede prior communications concerning the same subject.
22. Assignment
You may not assign your rights or obligations under these Terms without our prior written consent.
We may assign these Terms as part of a merger, acquisition, reorganization, sale of assets, or other lawful business transfer, subject to applicable law.
23. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except where the mandatory consumer laws of your jurisdiction apply.
Subject to those mandatory rights, legal proceedings relating to these Terms will be brought in the state or federal courts located in San Diego County, California, and the parties consent to the jurisdiction of those courts.
24. Changes to These Terms
We may update these Terms to reflect changes in our Services, practices, or legal obligations. We will publish the revised Terms and update the “Last updated” date.
When required by law, we will provide additional notice before a material change becomes effective.
